Software License Agreement

IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, DO NOT INSTALL THE SOFTWARE AND RETURN THIS ENTIRE PACKAGE WITHIN 30 DAYS OF YOUR RECEIPT FOR A FULL REFUND.

1. USE
The purchaser is licensed to use this program (the “Software”) on one computer at any one time. In addition you may make one (1) archival copy of the program for security purposes, but this is not to be used by any other individual.

2. RESTRICTIONS
Except as expressly authorised by the Agreement or the Release Notes, you may not alter, merge, modify or adapt the Software in any way including reverse engineering, disassembling or decompiling. This does not affect your statutory rights.

3. LIMITED WARRANTY
For ninety (90) days from your date of purchase, we warrant that (i) the software will substantially conform to the applicable user documentation and (ii) that the magnetic media on which the Software is distributed and the user documentation are free from any defects in materials and workmanship. We will, at our option, refund the amount you paid for the Software or provide you with corrected items at no charge provided that the defective item(s) is returned within ninety (90) days from the date of purchase. Any misuse or unauthorised modification of the Software will void this limited warranty.

4. SUPPORT
Support and any updates will only be available to registered users of the software.

5. LIMITATION OF LIABILITY
Because software is inherently complex and may not be completely free of errors, it is your responsibility to verify your work and to make backup copies. We will not be responsible for your failure to do so. In no event will we be liable for indirect, special, incidental, tort, economic, cover or consequential damages arising out of the use or inability to use our products or services, including, without limitation, damages or costs relating to the loss of profits, business, goodwill, data or computer programs, even if advised of the possibility of such damages. In no case shall our liability for money damages exceed the amount paid by you for the Software out of which the claim arose.

Most MIDI files are copyrighted by the author of the file. It is expressly forbidden for you to modify or edit these files without the permission of the author. Also you are not allowed to play these files in public or to sell them, again without the permission of the author.

It is the responsibility of the user to be fully aware of the copyright laws and to abide by them.

As a consequence it is the responsibility of the user to ensure that the use of MIDI3c and its format converters does not infringe the copyright of any MIDI files used.

A print function is provided within the Session Player module that lets you print out a Session Playlist which can then be used to obtain permission to play the listed tunes in that session from the relevant artists as required.

MIDI3c is fully Year 2000 compatible.
